Affiliate Registration
Upon initiating the registration process with Nekkto, the affiliate undertakes the commitment to furnish precise registration data and ensures the ongoing accuracy of this information throughout the collaboration. Additionally, the affiliate is obligated to transparently disclose their chosen methods of marketing and publishing within the designated section of the network. Any instance of providing inaccurate information or attempts to conceal data shall be deemed a violation of these terms. In such circumstances, the network retains the prerogative to take appropriate actions, including the potential closure or suspension of the affiliate’s account, with due notice at the network’s discretion.
The affiliate bears exclusive responsibility for maintaining the security of their account and explicitly agrees not to share login credentials or any other account-related information with third parties.
Throughout the registration process, affiliates may be prompted to submit specific due diligence documentation as requested by the network. This documentation serves to verify the affiliate’s identity and ensure compliance with regulatory requirements. All furnished data will be handled in strict accordance with safety protocols and will be utilized solely for verification purposes.
Affiliates are duty-bound to provide truthful, up-to-date, and accurate documentation as requested by the system. Any attempt to falsify or provide misleading information is strictly prohibited and may result in the immediate termination of the affiliate’s account. By submitting the required due diligence documentation, affiliates acknowledge and willingly comply with these verification procedures, integral to upholding the integrity and security of the network.
In exceptional circumstances, or when warranted by enhanced security measures, ongoing investigations, or fraud claims, the network reserves the right to request additional information from the affiliate. The affiliate, in turn, commits to complete cooperation and promptly providing any requested information.
The network, exercising its sole discretion, reserves the right to decline affiliate registrations without furnishing detailed explanations. Nekkto may reject registration requests based on internal criteria and considerations. The decision to refuse an affiliate’s registration is conclusive and does not necessitate justification or further explanation.
Billing and Payment Procedures
Remuneration Models:
- CPA (Cost Per Acquisition)
- Revenue Share
- This model involves a percentage calculated from the net revenues generated by the affiliates’ players.
- Hybrid
A payment model that integrates both CPA and Revenue Share.
Nekkto facilitates affiliate payments on a monthly basis, utilizing the payment details provided in the affiliate’s account. Earnings must meet or exceed the minimum payment threshold of two hundred (200) Euro for disbursement. In cases where earnings fall below 200 Euro, the amount will be rolled over to the subsequent month’s payment cycle.
It is imperative to recognize that the network holds no liability for discrepancies in payment details provided by the affiliate. Ensuring the accuracy and validity of the information is solely the affiliate’s responsibility to receive timely and accurate payments.
Should the affiliate fail to submit the requisite due diligence documents, payments will be temporarily paused, and funds will be transferred to the following month until all necessary information and documentation are provided. The network reserves the authority to pause, suspend, or cancel payments if suspicions of fraudulent activities arise.
It is crucial to acknowledge that the network exercises extensive autonomy in making financial decisions, encompassing payment adjustments and cancellations.
Furthermore, the network cannot be held responsible for the actions or inactions of advertisers (operators). Instances may arise where operators delay, cancel, or suspend payments, and the network is not accountable for such occurrences. Nevertheless, the network commits to deploying all reasonable efforts to recover payments owed in such situations.
Affiliate Responsibilities and Ethical Guidelines
The affiliate (the publisher) recognizes and commits to diligently marketing the provided materials in strict adherence to all applicable laws and regulations. While the Network endeavours to supply current compliance-related information, it is incumbent upon the affiliate to conscientiously observe all relevant laws, regulations, and rules, including those stipulated on the advertisers’ websites within each jurisdiction where the affiliate operates.
The affiliate assumes the responsibility of ensuring that all marketing activities align with legal requirements and industry-specific regulations in their operating jurisdiction. Explicitly, the affiliate agrees not to promote any provided materials to individuals under the age of 18 or minors. Furthermore, the affiliate pledges to refrain from targeting vulnerable groups and engaging in activities that could be construed as malicious or harmful, such as placing tracking links on websites featuring adult or violent content.
Participation in the Network’s programs entails a commitment from the affiliate to conduct marketing efforts with integrity, upholding the highest ethical standards.
The affiliate (the publisher) additionally acknowledges and agrees that obtaining any necessary licenses, permits, registrations, or other legal requirements applicable to their marketing activities is solely their responsibility. This includes, but is not limited to, licenses pertinent to specific industries, regions, or jurisdictions. The affiliate must ensure compliance with all legal obligations and regulatory prerequisites relevant to their promotional endeavours.
Nekkto does not assume responsibility for verifying the affiliate’s compliance with specific regulations, licensing, or registration requirements. The affiliate bears the sole duty to obtain and maintain any necessary permissions or authorizations to conduct their marketing activities lawfully.
The affiliate explicitly pledges not to engage in activities related to fraudulent marketing or employ techniques to artificially boost earnings within the Network. This encompasses refraining from encouraging individuals to register solely for the purpose of inflating CPA (Cost Per Acquisition) payments. Moreover, the affiliate commits to abstaining from direct marketing practices such as sending unsolicited SMS or email communications (spamming), avoiding brand bidding, which involves the use of brand-specific keywords for promotional purposes, and refraining from incentivizing users to register solely for obtaining CPA payments (incentivizing traffic).
Any attempt to manipulate earnings, deceive the Network, or engage in deceptive marketing practices is strictly prohibited. The affiliate undertakes to uphold the integrity of the network and its programs by conducting business with honesty, transparency, and ethical conduct.
In instances of fraudulent marketing activities, the Network reserves the right to request reimbursement from the affiliate for any paid amounts associated with such activities. The affiliate acknowledges and agrees that engaging in fraudulent marketing not only violates these terms but also the terms of advertisers.
Reimbursement may include any earnings obtained through fraudulent means, along with any additional costs incurred by the Network due to such actions.
By participating in the Network’s programs, the affiliate expressly consents to reimburse the Network for any losses or damages suffered due to fraudulent marketing practices of the affiliate.
Account Closure and Termination
The affiliate retains the prerogative to close their account at their convenience; however, upon account closure, no additional payments will be issued. Moreover, if an account remains inactive for a period of six months, the Network reserves the discretion to close the account. In such an event, the payment of accrued revenue share will be suspended, and the affiliate will relinquish any entitlement to future payments.
In addition, the Network upholds the authority to terminate the agreement with the affiliate and close their account in the event of a potential breach of these Terms and Conditions or the terms and conditions specified by the advertisers (operators).
Alternatively, the Network may exercise this right based on its discretion and extraordinary decisions made by its management. Such actions will be implemented in accordance with the Network’s policies, aimed at preserving the integrity of its programs and partnerships.
